Zero Tolerance Law

If you are found guilty of drunk driving under the age of 21 you will be punished under the Zero Tolerance Law. If your BAC (Blood Alcohol Content) is between .02 and .07 and it is your first offense you will be fined a minimum of $125, a six-month license suspension, as well as a $100 suspension termination fee. If it is your 2nd offense you will fined a minimum of $125 fine, either a one-year cancellation of your driver’s license or until you are age 21, whichever is longer, and a $100 re-application fee. If it is your second offense you may have a fine ranging from $500 - $750, jail time up to 30 days, and a six-month suspension of your license. A third offense of drunk driving could result in a $750 - $1,500 fine, jail time up to 180 days and a minimum one-year suspension of your license if the past violations were within five years. The first and second conviction is considered a traffic infraction, where the third is a misdemeanor.

If you are charged with a drunken driving offense that results in a .08 BAC or higher, then it will be considered a DWI (Driving While Intoxicated), which can come with harsher punishments. The punishments greatly vary depending on the how many times you have been charged prior. The first offense can result in a minimum of $500 - $1,000, up to one year of jail time and a six-month revocation of your license. The punishments increase each time you have been charged, as well as how much time has passed since the last charge. The punishment for a third offense within ten years of previous charges can include a $2000 - $10,000 fine, up to seven years of jail time and a minimum of a one-year revocation of your license.
