THE FEDERAL "THREE STRIKES" LAW

The Federal "Three Strikes" Law was enacted as part of the Violent Crime Control and Law Enforcement Act of 1994. The "Three Strikes" Law requires enhancement of sentencing for a defendant who has been convicted of two prior felonies.

AGGRAVATED ROBBERY

A person commits the offense of aggravated robbery when he or she during the course of a theft, which theft is committed with the intent to obtain or maintain control of property, intentionally, knowingly, or recklessly causes serious bodily injury to another person, uses or exhibits a deadly weapon, or causes bodily injury or threatens to cause injury to an elderly or a disabled person.

INJURY TO A CHILD, AN ELDERLY PERSON, OR A DISABLED INDIVIDUAL

A person commits the offense of injury to a child, an elderly person, or a disabled individual when the person intentionally, knowingly, or recklessly causes serious bodily injury or impairment to the child, the elderly person, or the disabled individual.

After a defendant is convicted of a crime, he may decide to file a postconviction motion or appeal his conviction. The types of postconviction motions the defendant may file differ from state to state. The defendant may file several different motions after a judgment has been entered against him.
